Terms and Conditions
These Terms govern access to Racklyst and the marketplace services provided through Racklyst.com.
1. Eligibility and accounts
You must be legally able to enter a binding agreement, provide accurate information, safeguard your credentials, and use only accounts you are authorized to control. Racklyst may require email, identity, payout, or other verification.
2. Marketplace role
Racklyst operates the marketplace and, for transactions charged through Racklyst’s Stripe platform account, acts as the payment merchant of record. Independent sellers remain responsible for the goods they list and for the accuracy, ownership, legality, safety, packaging, and fulfillment of those goods.
3. Listings and prohibited conduct
Listings must be truthful, complete, and supported by original or authorized content. Counterfeit, stolen, illegal, dangerous, recalled, restricted, or otherwise prohibited items are not allowed. Manipulation, harassment, spam, scraping, fraud, payment evasion, and attempts to bypass platform safeguards are prohibited.
4. Payments, fees, and taxes
Buyers authorize the displayed item amount, shipping, buyer-protection fee, applicable taxes, and total. Racklyst charges the buyer through its payment-provider account and later transfers eligible seller proceeds through Stripe Connect. Racklyst may be responsible for provider fees, refunds, disputes, and chargebacks under its provider configuration. Fees are shown before purchase and may change prospectively. Users remain responsible for tax obligations assigned to them by law.
5. Shipping and order completion
Sellers must ship within the stated period, use valid tracking, package items appropriately, and comply with carrier rules. Seller proceeds remain pending until delivery and buyer confirmation, automatic completion after the applicable review period (currently 3 calendar days unless a different period is displayed), or dispute resolution.
6. Cancellations, returns, and disputes
Cancellations, refunds, returns, and disputes are governed by the Refund Policy and Buyer Protection Policy. Racklyst may request evidence and make a reasonable decision based on account, listing, payment, carrier, message, and other relevant records.
7. Reviews and content license
Reviews must reflect genuine experiences. By uploading content, you grant Racklyst a nonexclusive, worldwide license to host, reproduce, adapt, display, and distribute that content as needed to operate and promote the marketplace, subject to applicable privacy rights.
8. Enforcement
Racklyst may hide content, delay or restrict transactions, suspend access, retain records, cooperate with lawful requests, or take other reasonable steps to protect users and the platform.
9. Disclaimers and limitation
The service is provided on an “as available” basis to the fullest extent permitted by law. Racklyst does not guarantee that every listing, user, carrier event, or transaction will be error-free. Any limitation of liability is subject to rights that cannot legally be waived.
